Frequently asked questions
Questions to consider before your next step
Can I sell my house while in foreclosure?
A sale may be possible before a completed foreclosure, but authority, payoff, equity, deadlines, and closing time all matter. Contact the servicer and a qualified attorney promptly, and make sure the closing company knows about every scheduled deadline.
How long does foreclosure take?
There is no universal timeline. The process varies by state, loan, court procedure, notices, and prior activity. Use the dates in your actual notices and confirm them directly with the servicer, court records where applicable, and qualified legal counsel.
Can foreclosure be stopped after receiving a notice?
A notice may arrive at different stages, and available options depend on the loan and applicable law. Contact the servicer, a HUD-approved housing counselor, and a qualified attorney as early as possible. Do not assume that an application, offer, or conversation pauses a deadline.
What happens if my house sells before the foreclosure auction?
If an authorized sale closes in time and produces or otherwise provides the funds required to satisfy the approved payoff and closing obligations, the foreclosure may be resolved through closing. Only the servicer, closing professionals, and legal counsel can confirm the transaction-specific result.
Can I sell if I owe more than the house is worth?
A normal sale may not produce enough to pay the mortgage and other obligations. A lender-approved short sale or another workout may be considered, but approval is not automatic. Get independent guidance before signing or relying on a proposed timeline.
What is a short sale?
A short sale is a transaction in which the mortgage holder agrees to accept less than the full amount owed from the sale. It requires lender review and written approval, can take time, and may have credit, tax, deficiency, or other consequences.
What happens to my equity during foreclosure?
Equity is the property's value above valid debts and costs, but a foreclosure sale, fees, liens, and local distribution rules can affect any remaining amount. Ask an attorney about your rights and request a transaction-specific payoff rather than relying on an online estimate.
Can I sell a house with unpaid property taxes?
A sale may be possible if the taxes and other required amounts can be addressed at closing. Property-tax foreclosure follows a different process from mortgage foreclosure, so confirm the taxing authority, deadlines, and redemption or sale status with qualified local counsel.
Will selling my house automatically stop foreclosure?
No. Listing the property, accepting an offer, or starting a closing does not automatically stop a scheduled foreclosure. Obtain written, transaction-specific confirmation from the appropriate parties and continue addressing all notices and deadlines.
What should I do if the foreclosure auction is approaching?
Act immediately. Contact the servicer, consult a qualified foreclosure attorney, and contact a HUD-approved housing counselor. Give any closing company the exact sale date and documents. Do not rely on a prospective buyer's promise that the auction will be postponed.
